b. One entry per person or household please. Multiple entries will not increase the odds of winning and may be subject to disqualification.
 
c. Persons under the age of 13 are not eligible to participate. We will immediately reject and delete any entry received from a person under the age of 13. Visitors are also required to provide truthful information and we will also reject and delete any entry we discover to be false or fraudulent.
 
2. Eligibility:
a. Contests are open for all 94.5 KBAY listeners (Bay Area California listener's only) Due to the nature of certain prizes, it may be necessary to restrict the age of the winner for certain contests. In this case, an age limit will be specified within the contest announcement.
 
b. Employees of KBAY FM, affiliated entities, affiliated advertising agencies, participating sponsors/promotional partners,   other radio stations in the San Jose metropolitan area and the members of their immediate families are ineligible to participate or win.
 
c. Contestants may only win from KBAY FM once every 60 days for prizes valued up to $600.00.
 
d. Contestants are eligible to win a prize valued at $600.00 or more only once every six months.
 
e. One winner per household is permitted in any contest.
 
3. Prizes:
a. All prizes or prize certificates may be picked up at the business offices of KBAY FM- 190 Park Center Plaza, 2nd floor, San Jose, CA 95113. Pick-ups must be made during regular business hours M-F 8:30am-5:30pm.
 
b. Any prize or prize certificate not claimed within 45 days of winning will be forfeited by the winner.
 
c. In the event that a prize or prize certificate (concert tickets, trip certificates, or cash prizes will not be mailed), is mailed to the winner, it will be with the prior consent of the winner and therefore, winner assumes the risk of its arrival. KBAY FM is not responsible for the safe arrival of a prize or prize certificate.
 
d. Contest prizes are not transferable. Prizes may not be substituted or redeemed for their cash value.
 
e. Due to the nature or value of certain prizes, 94.5 KBAY reserves the right to require a valid picture I.D. from any winner.                  

4. Selection of Winners:
a. All decisions of station management with respect to contests are final.
 
b. Selection of winners is random, unless announced otherwise.
 
c. In cases of skill-based contests, contestants will be informed of the judging criteria beforehand.
 
5. Conditions:
a. Payment of all federal, state or local taxes are the sole responsibility of the winner. Winners may be required to sign an IRS Form 1099 or the equivalent.
 
b. By participating in any contest, the winner or winners agree to have their name, voice or likeness used in any advertising or broadcasting material related to the contest.
 
c. Contest winners will be required to sign a liability release prior to the acceptance of any prize valued at $600.00 or greater or with a prize that includes the provision of transportation whether or not such transportation is provided by 94.5 KBAY FM. Pursuant to the liability release, the winners will agree to hold 94.5 KBAY FM, affiliated companies and their officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or contest.
 
d. Contest winners who have accumulated more than $600.00 in prizes over a one-year period may be required to sign an IRS form 1099 or the equivalent.
 
6. 94.5 KBAY FM reserves the right to make changes in the rules of the contest which will become effective upon announcement.
a. No purchase is necessary. The contest is void where prohibited.
 
b. Failure to comply with the contest rules may result in a contestant's disqualification.
 
c. Copies of the contest rules are available during regular business hours, M-F 8:30a - 5:30p, at the main studios of 94.5 KBAY FM:

7. Insiders E-Mail Club Rules:
a. Any and all of the prior rules listed may apply.
                   
b. To become a member, you must complete the Insider's E-Mail Club entry form at www.todaysbestmix.com and press the submit button or send your name, address, valid e-mail address and daytime phone number on a 3"x 5" card to: Insider's/94.5 KBAY, 190 Park Center Plaza Suite 200, San Jose, CA 95113
                   
c. Any person submitting an entry to the Insider's E-Mail Club does so of their own free will. The list will not be used for purposes outside of the realm of KBAY FM and its promotional/advertising partners. KBAY FM reserves the right to contact club members via email, phone or postal mail.
                   
d. At various unscheduled intervals, 94.5 KBAY will conduct contests open only to club members. Various prizes to be given away will include, but are not limited to concert tickets, CD's, movie passes etc.
                   
e. KBAY FMwill at various unscheduled times furnish members with concert, station or artist information, as well as other information that the station management finds of listener value.
                   
f. Any email message that is mass-mailed to club members may be obtained free of charge by submitting a written request to:

g. Due to new federal laws, we will not accept any email address that is to be used for messages sent directly to a mobile device.  Any such email address will be rejected. Messages that are forwarded to a PDA, such as a BlackBerry or Palm Pilot, or a cell phone from an email address that is not directly associated with a mobile device are not effected by this policy.
                   
h. Club members may withdraw at any time by submitting a written request with their full name and email address to the above address.
                   
i. 94.5 KBAY FM reserves the right to determine the rules and procedures for each on-air/email contest. Prizes will be given away at the discretion of the station management. All decisions of 94.5 KBAY FM judges in all contests are final.
                   
j. 94.5 KBAY FM is not responsible for any email that is lost, incomplete, illegible, misdirected or has failed due to partial or garbled computer transmission or any other failure including internet traffic.
                   
k. Only one entry per person is allowed into the Insider's E-Mail Club. Multiple entries will be purged and do not increase the odds of winning any prize. Contestants may not enter with multiple email addresses. Any contestant attempting to register with multiple email addresses will be automatically disqualified.
                   
l. 94.5 KBAY FM reserves the right to cancel or modify any promotion or contest if fraud or technical failures destroy the integrity of the promotion or contest, as determined by KEZR FM in its sole discretion and without notice.


Rules for the Disney Dream Maker Contest

a.                   There will be a total of nine (9) on-air prizes consisting eight (8) 2-day Park Hopper® Tickets to the Disneyland® Resort.  Each prize pack is valued at approximately $1,056.00.  Tickets are for the winning person and seven guests of his/her choice.  The Tickets may not be redeemed for cash, sold, traded, used for commercial purposes or transferred.  Tickets must be used by December 15, 2008.  Certain restrictions shall apply to the Tickets as determined by Disney.  Disney, its parent, subsidiary, related and affiliated companies and their respective officers, directors, employees and agents shall be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions which arise out of an/or in any way related to the prize, the receipt, use, and /or enjoyment of the prize and/or Promotion.

b.                   There will be a total of one (1) website grand prize vacation for the winner and their guests including their nominee and their guests for a total of 8 travelers.  Vacation includes: Round-Trip coach airfare for eight (8) from San Jose, CA to a Southern California airport as chosen by Disney, May 8, 2008 through May 10, 2008; ground transfers to and from the airport to the hotel,  hotel accommodations (2 rooms, quad occupancy) for 3 days and 2 nights at a Disneyland Resort Hotel, May 8, 2008 through May 10, 2008; eight 3-day Disneyland® Resort Park Hopper® Tickets; and eight tickets to an exclusive Dream Party at Disneyland® park on May 8, 2008 from 9 p.m. to 1 a.m.  Total value approximately $4,312.00.  Grand Prize Winner and travel companions are solely responsible for all applicable taxes, including, but not limited to, hotel, hospitality and airport taxes, ground transportation, telephone charges, meals, gratuities, transfers, spending money and any other expenses not specifically offered herein.  Grand Prize Winner may be required to present a valid credit card upon check in at hotel to cover any incidental expenses.  Winner and nominee must travel May 8 – 10, 2008.
